Europe adopts a new process against terrorism inspired by the american model... FREEDOM IN DANGER...

European Commission will adopt on Tuesday the 6th, an new plan to act against terrorism. One of the key measures is the installation of a data baseincluding aerien passengers' personnal informations, going to or coming from the Union. This process won't be applyed in between european countries, but between a member state and a foreign one.

Such a system is already used by the US, concerning all passengers enterring the land. After hard negociations between Bruxelles and Washigton, european airlines now have to give to americans "19 informations"... The same deal has been concluded with Canada. The proposition of the Commission intends to give to the european states the same disposal.

This project, which has to be subjected to the council of ministers, has been raised up several times by the European Union, for instance just after the terrorist attacks in Madrid (March 2004) then London (July 2005). It has been consulted either by states members and airlines companies. Yet, we can already face a lot of protestations. The british association of freedom defense "Statewatch" is denouncing "a new measure which puts everybody under surveillance and makes everyone a suspect, without giving him the rights to know how the data will be used."

Nineteen data will have to be transmitted to the authorities of the concerned state, just in order to identify people who could potentially be linked to some terrorist action, in order to establish "risks indicators" to evaluate their dangerousity, in order to give informations upon terrorist methods, or also, in order to be used as a data base for criminal enquiries.

These data, which will be easily transmitted to other states members in case of need, will contain the name, the address, the phone number, the credit card number, and the itinerary of the passenger, excepted everything that could reveal his ethnic or racial origin, his political opinions, his religious or philosophical beliefs, his attachment to any syndicate, or concerning his health, nor upon his sexual life.

The Commission insists on the balance between public security demands and the protection of fundamental rights. The capable authorities of the states members will keep the informations as long as the enquiry needs it, and dependind on the purpose.

The Commission proposes it shouldn't overpass five years, followed by an eight years latent period in which only very special circumstances could give access to the data. Then they will have to be destroyed. Neverthless, in the case of a criminal enquiry or intelligence operation, the duration could be extended.

Other measures will be announced on Tuesday, in name of the Commission, by Franco Frattini. One is about security in the field of explosives. Mr Frattini, reminding us that terrorist attacks of Madrid were executed thanks to explosives that are allowed in free marcket, proposes to create for the european Office of police Europol a special data base only for explosives. He also proposes to establish an alert system which could permiss the capable authorities to be quickly informed as soon as explosives are stolen or if a new way of terrorism action is discovered.

Another disposition intends to regulate the use of the internet. As he says, terrorists use the internet for the organization of the attacks, to send propaganda messages or also to diffuse instructions concerning the way of making the explosives. Mr Frattini wants the Union to punish those kinds of behaviours.
